2011 BOSS LOOP STATION CONTEST - AUSTRALIA
TERMS & CONDITIONS
:
- Employees, their parents, siblings, spouses, children and persons domiciled with employees of Roland Australia are ineligible to enter. Additionally, employees of parent companies, subsidiaries or divisions of Roland Australia, as well as promotional and advertising agencies hired by Roland Australia are ineligible to enter.
- Roland Australia may, in its sole discretion, prevent any person believed to be abusive, from entering the Contest. Abuse includes, but is not limited to, tampering with the entry process or the operation of the Contest, acting in violation of the Contest Rules, or Terms and Conditions, or behaving in an unsportsmanlike or disruptive manner. Entries that contain prohibited or inappropriate content as determined by Roland Australia, in its sole discretion, will be disqualified.
- Only one entry per person. Any individual suspected of submitting more than one entry, regardless of the method or means, will be disqualified. The name of the person entering the Contest must be the authorised accountholder of the email address on the entry form. Otherwise, the entry may be disqualified. If there is a dispute over the identity of a winner, the entrant will be required to prove identification to show that he or she is the authorised account holder of the email address on the entry form.
- It is the entrant's sole responsibility to notify Roland Australia in writing if he or she changes his or her details (eg. email, phone or postal address) during the Contest period.
- Unauthorised use of Roland Australia's intellectual property, including logos, designs, promotional materials, web pages and representations, without express written permission, is strictly prohibited.
- Roland Australia is not responsible for the failure to complete each step of the registration or entry process on time.
- Roland Australia reserves the right to disqualify, without notice to the entrant, any entrant who, or whose entry, does not meet any of the criteria stated to enter the Contest or who breaches the Rules or Terms and Conditions of the Contest.
- Entrants acknowledge that participation in or winning the Contest does not guarantee that their submissions will be used by Roland Australia.
- All prizes will be awarded provided a sufficient number of qualified eligible entries are received. Non winning and/or ineligible entrants will not be contacted.
- The Contest Rules and Terms and Conditions are governed by and are to be construed in accordance with the laws of New South Wales, Australia.
WARRANTIES FROM ENTRANT
- On entering a submission to the Contest, you, as the entrant, represent and warrant that:
(a) your Video Entry and all elements contained therein (Content) and all live performances by you (at any subsequent Contest-related events or activities) will be and are your original work, have not and will not be copied or contain samples from any third party's work, have not been previously published or distributed in any media and have not been entered in or won previous contests or rewards and that the Content does not violate any copyright, trade mark, publicity right or other right of any third party; and
(b) you meet the requirements and qualifications for the Contest and that you have read the Contest Rules and Terms and Conditions and are fully familiar with them. You agree that on becoming the winner of the Contest, that you will sign and agree to the Eligibility Talent Consent & Release form. This form will assign certain intellectual property rights to Roland Australia and will include, as relevant, consents to Roland Australia and its affiliates, agents and co-sponsors doing certain acts which may otherwise be considered to be in breach of your moral rights; and
(c) you own all rights to your Video Entry including, without limitation, the copyright in the visual and sound recording and the performance rights and will assign to Roland Australia all such rights in the Video Entry as set out in the Eligibility Talent Consent and Release in the event that you win the Contest. - You agree to indemnify and hold Roland Australia, its officers, directors, employees, contractors, agents and representatives harmless from and against any third party claim (including reasonable legal fees and costs) arising from any use of Content.
- Any of your entry information collected from the Contest will be used only in accordance with the Rules, Terms and Conditions and the consent given by you at the time of entry and/or at the time a prize is awarded and in accordance with Roland Australia's then current Privacy Policy.
RELEASE
As a condition of entry into the Contest, you, as an entrant agree to release Roland Australia, its directors, officers, employees, personnel, parents, subsidiaries, affiliated companies, contractors, agents, representatives, suppliers, printers, application developers, advertising, promotional or judging agencies (the “Released Parties”), from and against:
- any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with participating in the Contest or accessing any website including <youtube.com> in connection therewith;
- submitting an entry or otherwise participating in any aspect of the Contest;
- the receipt, ownership or use of any prize awarded; and
- preparing for, participating in, or travelling to and/or from any Contest-related or prize-related activity, or any typographical or other error in these Rules or Terms and Conditions or the announcement of offering of any prize.
The Released Parties are further not liable for damage to an entrant or user's computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to an entrant's participation in the Contest or downloading of information in connection with the Contest. The Released Parties are not liable in the event that any portion of the Contest is cancelled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a “Force Majeure Event”). Should a Force Majeure Event occur, Roland Australia may, but is not obliged to, exercise commercially reasonable efforts to complete the Contest or any Contest-related activity at another time.
TRAVEL FOR THE INTERNATIONAL LOOP STATION CONTEST FINAL
If you are selected as a finalist to perform at the International Loop Station Contest, Roland Australia will provide travel to the winner of the Australian Contest to perform at the International Loop Station Contest as set out below.
Any additional people that the finalist chooses to accompany him or her will be the sole responsibility of the finalist. Roland Australia will have no obligation for any additional expenses.
If you are selected as a finalist to perform at the International Loop Station Contest, you must utilize the travel only for the purpose of performing at the live competition in order to remain eligible to win a prize. Travel and/or accommodation will be designated and booked solely by Roland Australia and may be changed without notice at any time by Roland Australia in its sole discretion.
Booking restrictions apply and due to capacity controlled seating, flexibility of travel dates may be necessary. Once booked by Roland Australia, travel arrangements may not be changed (though restrictions and blackout dates may apply unless the change is made by Roland Australia). Prize winners remain responsible for all expenses not specifically stated as part of any prize awarded, including but not limited to, government or airport taxes, carrier surcharges, service charges, local transportation including air or ground transportation from the finalist’s residence to the airport, overnight accommodation prior to or following the travel dates in order to accommodate flight connections, income taxes, insurance, passport and visa costs, gratuities, all meals, beverages, incidentals and any items of a personal nature.
Cancellation insurance is not part of the prize, airfare or any accommodation. It is recommended that the finalists obtain their own insurance.
Prize winners remain responsible for having or obtaining adequate documentation for travel. Airfare and/or accommodation must be accepted as awarded with no substitution. Airfare and/or accommodation are non-transferable and cannot be redeemed for cash or credit, in whole or in part, for any destination.
